Terms of Use and AI-Output Disclaimer
Rules for using StackWise and important limitations on software recommendations, estimates, roadmaps, and AI-generated material.
StackWise provides general informational guidance. AI output can be incomplete, outdated, or wrong. Verify important decisions with the software provider and qualified professionals.
1. Acceptance of these Terms
These Terms of Use (“Terms”) are an agreement between you and The Hemphill Group, LLC, the operator of StackWise (“StackWise,” “we,” “us,” or “our”). By accessing or using stackwise.studio or a related StackWise feature, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility and business use
You must be at least 18 years old and legally able to enter an agreement to use StackWise. If you use StackWise for an organization, you represent that you are authorized to accept these Terms for that organization. StackWise is intended for lawful business research and planning.
3. The service
StackWise may provide AI-assisted assessments, software recommendations, comparisons, estimated prices, estimated time savings, workflow suggestions, implementation roadmaps, editorial content, and links to third-party products. We may modify, suspend, or discontinue any feature, content, or provider listing at any time.
4. AI-output disclaimer
Some StackWise content is generated, summarized, selected, or personalized with artificial intelligence. AI systems can produce inaccurate, incomplete, biased, inconsistent, or outdated output, including fabricated statements. Similar prompts can produce different results.
- Review output for accuracy, completeness, security, accessibility, and suitability before relying on it.
- Confirm pricing, features, contract terms, integrations, availability, and data practices directly with the provider.
- Do not rely on StackWise as the sole basis for a material purchasing, staffing, security, compliance, or operational decision.
- Keep appropriate human review and backups when implementing an automation or workflow.
5. No professional advice
StackWise does not provide legal, tax, accounting, investment, employment, insurance, cybersecurity, medical, or other regulated professional advice. A recommendation or roadmap does not create a professional-client, fiduciary, agency, partnership, or advisory relationship. Consult a qualified professional for decisions requiring professional judgment.
6. Estimates and claimed outcomes
Costs, time savings, implementation periods, productivity gains, return on investment, and other projected outcomes are illustrative estimates. Actual results depend on business volume, staffing, configuration, adoption, provider pricing, technical constraints, and other factors. StackWise does not guarantee savings, revenue, compatibility, implementation success, or any particular result.
7. Third-party products and links
Third-party products are offered and controlled by their providers. StackWise is not responsible for their availability, performance, security, accessibility, data handling, billing, support, contract terms, or changes. Your use of a third-party product is governed by your agreement with that provider.
Some external links may be affiliate or referral links. StackWise may receive compensation for qualifying actions. Additional information is provided in our Affiliate Disclosure. Compensation does not convert StackWise into the seller or service provider for the third-party product.
8. Your submissions
You retain any rights you hold in text or other material you submit. You grant StackWise a nonexclusive, worldwide, royalty-free license to host, reproduce, transmit, process, and transform your submission as necessary to provide, secure, maintain, and improve the service, subject to our Privacy Policy.
You represent that you have the rights and permissions needed to submit the material. Do not submit passwords, payment-card data, protected health information, government identifiers, trade secrets, client-confidential information, personal data you are not authorized to disclose, or content that violates law or another person’s rights.
9. Acceptable use
You may not use StackWise to violate law or rights; distribute malware; probe or defeat security; scrape or access the service through unauthorized automated means; interfere with operation; misrepresent output as verified professional advice; reverse engineer protected portions except where law permits; or use the service to create deceptive, discriminatory, or harmful activity.
10. Intellectual property
StackWise, its design, software, branding, editorial material, and compilation of recommendations are owned by The Hemphill Group, LLC or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to use the service for internal business evaluation. No other rights are granted.
11. Feedback
If you provide ideas or feedback about StackWise, you grant us permission to use them without restriction or compensation, provided that this does not override rights in personal information under applicable law.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACKWISE IS PROVIDED “AS IS” AND “AS AVAILABLE.” THE HEMPHILL GROUP, LLC DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. WE DO NOT WARRANT THAT OUTPUT OR LINKS WILL BE ERROR-FREE, CURRENT, COMPLETE, OR SUITABLE FOR YOUR NEEDS.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HEMPHILL GROUP, LLC AND ITS OWNERS, PERSONNEL, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO STACKWISE, AI OUTPUT, OR A THIRD-PARTY PRODUCT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID DIRECTLY TO THE HEMPHILL GROUP, LLC FOR STACKWISE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain exclusions or limits, so some provisions may not apply to you.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Hemphill Group, LLC and its owners, personnel, affiliates, and service providers from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of StackWise, your submissions, your violation of these Terms, or your infringement of another person’s rights.
15. Suspension and termination
We may limit, suspend, or terminate access where reasonably necessary to protect the service, users, third parties, or our legal interests. You may stop using StackWise at any time. Provisions that by their nature should survive termination will survive.
16. Governing law and disputes
These Terms are governed by the laws applicable to The Hemphill Group, LLC at its principal place of business, without regard to conflict-of-law principles. Before filing a claim, each party agrees to make a good-faith effort to resolve the dispute informally through hello@stackwise.studio. Any mandatory rights or venue rules under applicable law remain unaffected.
17. Changes and general terms
We may revise these Terms by posting an updated version and changing the effective date. Continued use after the updated Terms take effect constitutes acceptance where permitted by law. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or asset transfer.
